Morocco’s MAD 10.63 Billion Land Registry Modernization
Morocco’s Agence Nationale de la Conservation Foncière, du Cadastre et de la Cartographie (ANCFCC) is implementing a MAD 10.63 billion modernization program to digitize the country’s land registration system. For foreign investors, this initiative significantly reduces the due diligence risk traditionally associated with Moroccan real estate acquisitions.
The Dual Property System: What Investors Must Know
Morocco operates two parallel property ownership regimes. Titre foncier (registered title): provides definitive, indefeasible ownership evidenced by a cadastral certificate — the gold standard for foreign investors. Melkia (unregistered traditional ownership): evidenced by notarial acts (mouhdar) without cadastral backing, carrying substantial risks of competing claims, undivided co-ownership and boundary disputes.
New Digital Verification Tools
The ANCFCC’s digitization program now enables online title certificate requests, digital cadastral map consultations and real-time encumbrance searches (mortgages, seizures, legal mentions). These tools dramatically reduce the time required for property due diligence from weeks to days, enabling faster transaction timelines.
Persistent Risks Requiring Legal Attention
Despite digitization, foreign investors must still verify: undivided co-ownership interests that may not be fully reflected in the register; rights of pre-emption (droit de chouf) under Moroccan succession law; outstanding municipal taxes and conservation foncière fees; and compliance with the urban development plan (Plan d’Aménagement) for the intended use.
