Areas of intervention

Commercial law &
regulatory compliance

We provide legal solutions to help businesses navigate complex regulatory environments and protect their commercial interests.

01

Customs Law & International Trade

Import/export regulatory compliance and customs policies

We assist importing and exporting companies in achieving compliance with the Moroccan Customs Code, foreign trade regulations, and free trade agreements (FTAs) to which Morocco is a signatory. Our advisory covers customs economic regimes (temporary admission, bonded warehouse, drawback), simplified procedures, obtaining Authorized Economic Operator (AEO) status, and optimization of international logistics flows.

We advise and represent our clients in disputes relating to customs valuation, tariff classification of goods (Harmonized System nomenclature), origin of products, and anti-dumping or countervailing duties. Our expertise enables us to challenge customs reassessments, obtain binding tariff information, and defend our clients’ interests before conciliation committees and competent courts.

We defend our clients facing customs offences: contraventions, customs crimes, seizure of goods, fines and penalties. Our intervention covers criminal proceedings before courts, negotiation of customs settlements, and appeals against administrative sanction decisions. We also assist companies in implementing compliance programmes to prevent the risk of violations.

02

Data Protection

Moroccan data protection law compliance

We support companies in achieving compliance with Law 09-08 on the protection of individuals with regard to the processing of personal data. Our advisory covers auditing existing processing activities, data mapping, implementing processing registers, appointing data controllers, and adapting internal processes to CNDP requirements. We also advise on international data transfers and their contractual framework.

We draft all documentation relating to data protection: privacy policies adapted to various media (websites, mobile applications, forms), data processing agreements (DPAs), standard contractual clauses for international transfers, IT systems usage charters, and procedures for managing data subject rights (access, rectification, deletion, portability).

We handle all formalities with the National Commission for Personal Data Protection: prior declarations, authorization requests for sensitive processing, data breach notifications, and responses to CNDP inspections and formal notices. Our expertise secures the relationship with the regulatory authority and anticipates regulatory developments in Morocco’s data protection framework.

03

Labor Law & Severance

Employment contracts and compensation package drafting

We draft and negotiate all contracts and documents related to the employment relationship: fixed-term and indefinite-term contracts, executive contracts, non-compete and confidentiality clauses, variable compensation packages (bonuses, profit-sharing), stock option and free share plans, and international mobility agreements. Each document is designed to protect the employer’s interests while respecting mandatory provisions of the Moroccan Labor Code.

We support companies in developing and updating their internal policies: internal regulations, ethics charters, remote working policies, disciplinary procedures, and company agreements. Our advisory covers compliance with the Labor Code (Law 65-99), applicable collective agreements, and labor inspection requirements. We also assist companies in their relations with employee representative bodies and social dialogue management.

We represent employers and executives in all employment disputes: challenges to dismissals (for gross misconduct, economic, for incapacity), disputes relating to overtime and classifications, moral harassment and discrimination, and workplace accidents. We also conduct internal investigations in cases of suspected fraud, harassment, or professional misconduct, ensuring respect for defense rights and preservation of evidence.

Frequently Asked Questions

Frequently Asked Questions

What are the data protection obligations in Morocco?

Law 09-08 requires data controllers to declare their processing to the CNDP, obtain consent from data subjects, secure the data, and respect access, rectification, and deletion rights. International transfers are regulated. Non-compliance exposes organizations to fines and administrative sanctions.

Challenging a customs reassessment follows a strict procedure: filing a claim with the administration within legal deadlines, then appealing to the administrative court. Grounds for challenge include tariff classification, customs value, origin of goods, or procedural irregularity. Solid documentation and binding tariff rulings strengthen the chances of success.

A franchise agreement should cover the exclusive territory, royalties and entry fees, training and supply obligations, quality standards, renewal and termination conditions, and post-contractual non-compete clauses. The pre-contractual information document (DIP) must be delivered at least 20 days before signing, in line with international practices.

Dismissal must be based on a real and serious cause. The procedure varies by motive: gross misconduct, professional inadequacy, or economic reasons. Notice period and severance pay are calculated based on seniority and compensation. Failure to follow procedure exposes the employer to damages. Legal counsel is recommended at every step.
